RNC: We don't need no ste-ee-enking accountability

just buzz off, will ya...?
After promising last year to search its computers for tens of thousands of e-mails sent by White House officials, the Republican National Committee has informed a House committee that it no longer plans to retrieve the communications by restoring computer backup tapes, the panel's chairman said yesterday.

The move increases the likelihood that an untold number of RNC e-mails dealing with official White House business during the first term of the Bush administration -- including many sent or received by former presidential adviser Karl Rove -- will never be recovered, said House Democrats and public records advocates.

[...]

Spokesman Danny Diaz said in a statement that the RNC "is fully compliant with the spirit and letter of the law." He declined further comment.

a promise...? just words... the big boss doesn't keep 'em, why should WE...?

Illegally doing lots of government business over political party email servers

some fairly mind-boggling additional information from waxman's house oversight committee...

first of all, the practice was widespread...

In March 2007, White House spokesperson Dana Perino said that only a “handful of officials” had RNC e-mail accounts. In later statements, her estimate rose to “50 over the course of the administration.” In fact, the Committee has learned from the RNC that at least 88 White House officials had RNC e-mail accounts. The officials with RNC e-mail accounts include Karl Rove, the President’s senior advisor; Andrew Card, the former White House Chief of Staff; Ken Mehlman, the former White House Director of Political Affairs; and many other officials in the Office of Political Affairs, the Office of Communications, and the Office of the Vice President.

secondly, the volume of useage was much heavier than was initially thought...
The RNC has preserved 140,216 e-mails sent or received by Karl Rove. Over half of these e-mails (75,374) were sent to or received from individuals using official “.gov” e-mail accounts. Other heavy users of RNC e-mail accounts include former White House Director of Political Affairs Sara Taylor (66,018 e-mails) and Deputy Director of Political Affairs Scott Jennings (35,198 e-mails). These e-mail accounts were used by White House officials for official purposes, such as communicating with federal agencies about federal appointments and policies.

third, deletion and destruction was undertaken on a wholesale basis...
Of the 88 White House officials who received RNC e-mail accounts, the RNC has preserved no e-mails for 51 officials. In a deposition, Susan Ralston, Mr. Rove’s former executive assistant, testified that many of the White House officials for whom the RNC has no e-mail records were regular users of their RNC e-mail accounts. Although the RNC has preserved no e-mail records for Ken Mehlman, the former Director of Political Affairs, Ms. Ralston testified that Mr. Mehlman used his account “frequently, daily.” In addition, there are major gaps in the e-mail records of the 37 White House officials for whom the RNC did preserve e-mails. The RNC has preserved only 130 e-mails sent to Mr. Rove during President Bush’s first term and no e-mails sent by Mr. Rove prior to November 2003. For many other White House officials, the RNC has no e-mails from before the fall of 2006.

and, in direct contravention of the presidential records act, it appears that gonzo knew of the destruction and did not act to enforce the law...
In her deposition, Ms. Ralston testified that she searched Mr. Rove’s RNC e-mail account in response to an Enron-related investigation in 2001 and the investigation of Special Prosecutor Patrick Fitzgerald later in the Administration. According to Ms. Ralston, the White House Counsel’s office knew about these e-mails because “all of the documents we collected were then turned over to the White House Counsel’s office.” There is no evidence, however, that White House Counsel Gonzales initiated any action to ensure the preservation of the e-mail records that were destroyed by the RNC.

not only does it appear that the presidential records act was violated, there was complete disregard for internal white house policy set forth in 2001 that was put in place specifically to insure compliance with the act...
To implement this legal requirement, the White House Counsel issued clear written policies in February 2001 instructing White House staff to use only the official White House e-mail system for official communications and to retain any official e-mails they received on a nongovernmental account.

why are these people still in office...? why haven't we stormed the white house with rakes and hoes, buckets of tar and sacks of feathers, and run the entire lot of them out of town on a rail...?

Rove is in it up to his fat ass

where there's smoke, there's rove...
In the rough and tumble of Alabama politics, the scramble for power is often a blood sport. At the moment, the state's former Democratic governor, Don Siegelman, stands convicted of bribery and conspiracy charges and faces a sentence of up to 30 years in prison. Siegelman has long claimed that his prosecution was driven by politically motivated, Republican-appointed U.S. attorneys.

Now Karl Rove, the President's top political strategist, has been implicated in the controversy. A longtime Republican lawyer in Alabama swears she heard a top G.O.P. operative in the state say that Rove "had spoken with the Department of Justice" about "pursuing" Siegelman, with help from two of Alabama's U.S. attorneys.

it's vintage rove and ties right in with the use of the justice department as a wholly-owned subsidiary of the republican national committee, which, in turn, is a wholly-owned subsidiary of the cabal installed by the scotus decision of 12 december 2000...

Susan Ralston takes the 5th on Abramoff and White House RNC email accounts

so, she's got some goodies on jack and his relationship with the white house and his bestest friend, karl rove...
"The subjects this morning that she will be unable to testify to...are the subjects of the relationship between Jack Abramoff and his associates and White House officials, including Ms. Ralston, and the subject of the use by White House officials of political e-mail accounts at the RNC," Ralston's lawyer, Bradford Berenson said, during the May 10 deposition. "She has material, useful information about both of those subjects."

[...]

"She is more than willing to provide it to the committee. However, she will, as we have previously discussed, require a grant of immunity before she is comfortable going forward," Berenson also said in the deposition.

give her immunity and then waterboard her until she tells us everything she knows...

Patrick Leahy as Lieutenant Columbo

from TPMmuckraker...
Tired of waiting for a response, Senate Judiciary Chairman Pat Leahy (D-VT) issued a subpoena for any of Karl Rove's emails in the Justice Department's possession that might be relevant to the U.S. attorney firings. That includes emails sent from Rove's White House account (which apparently doesn't get much use) and emails from his account issued by the Republican National Committee.

now that we know that gonzo delegated away his hiring and firing authority, i'm sure leahy knows who exercised it, and it certainly wasn't sampson and goodling... when one ostensibly gives away one's power to relatively inexperienced staff political operatives to select highly experienced professionals, serious questions naturally arise... there seems no doubt that the REAL deciders were in the white house... this whole thing has smelled of karl rove from the get-go and, unless and until karl gets waterboarded into divulging what he knows, leahy's just going to have to continue with his peter falk, columbo routine...

Schlozman: disdainful and vitriolic

TPMmuckraker has the lowdown on brad schlozman...
"He was universally despised by career people. He was the most disdainful and vitriolic guy I've ever dealt with, and he had it in for everybody."

looks like there's no longer any doubt, the justice department was merely a branch office for the white house, which, in turn, was merely a wholly-owned subsidiary of karl rove inc. and the republican national committee...
Schlozman was appointed to be the interim U.S. attorney in western Missouri on March 23, 2006 -- just two weeks after the president had signed the USA Patriot Act into law; the bill contained a provision that allowed interim U.S. attorneys to serve indefinitely.

Schlozman, who had zero prosecutorial experience, was installed as the U.S. attorney in western Missouri -- where Jim Talent was battling Claire McCaskill in one of the closest Senate races in the country. The administration appointed him suddenly and without consulting the senior Republican senator in the state, Sen. Kit Bond (R-MO). A spokeswoman for Bond said that "Senator Bond was informed of Mr. Schlozman's appointment when he was named as interim U.S. attorney for the Western District of Missouri."

"most disdainful and vitriolic" is quite a statement... i've observed folks like that in action in the private sector and it isn't pretty... sure, you take a lot of shit from them that you should never have to take out of fear of losing your job, but, what it amounts to, without beating around the bush (pardon the pun, please), is nothing more or less than verbal and emotional abuse... what's usually worse is that THEIR bosses are often aware of such behavior and do nothing... needless to say, that kind of boss NEVER behaves that way in front of HIS boss, so HIS boss just writes it off to whining employees...

Push, push, push on the Bush

woo-hoo...! 3 (count 'em, 3) subpoenas... now that they're approved, will they be issued...?
"We have hit a brick wall with the Secretary of State," said Rep. Henry Waxman (D-CA). "She will not propose a date to testify, she will not agree to testify, and she insists that our Committee be satisfied with partial information that was previously submitted to other committees."

Waxman's remark came in a fractious hearing on issuing three subpoenas. One sought Rice's testimony on May 15 concerning the intelligence used to justify the invasion of Iraq. The other two concerned the deletion of e-mails on accounts supplied the Republican National Committee and used by White House employees, as well as RNC documents concerning the use of the General Services Administration to assist Republican political efforts.

All three subpoenas were agreed to by the Committee.

while, as committee chair, waxman has the power to unilaterally approve and issue the subpoenas, he opened the matter to full committee debate and vote...
"Under the rules of this Committee, the Chairman has the power to issue subpoenas without debate or votes in the Committee. That is what Dan Burton used to do. In fact, that is what he did over 1,000 times," he said. "But I am taking a different approach today. I believe the entire Committee should have a chance to participate in the subpoenas we will consider today."

push, push, push on the bush...

[UPDATE]

according to this ap account, a subpoena will be issued to rice...
By 21-10, the House oversight committee voted to issue a subpoena to Rice...

Fine... Do it... Let's get it ALL on the table...

as a concerned citizen who has watched my country progressively going downhill for a long, long time, well before george and bill, i say, go for it...
"As Democrats gear up for a broad investigation of Republican e-mail accounts, GOP staff warn that the issue could come back to haunt Democrats, as the minority is looking for ways to extend the issue into Democratic e-mails as well," Paul Singer and Rachel Van Dongen write for Roll Call.

The paper reports, that "Brian McNicoll, a spokesman for Oversight and Government Reform Committee Republicans, warned that if Democrats want to broadly investigate the use of party e-mail accounts by administration officials, Republicans could extend this investigation back to the end of the Clinton administration as well."

"If you can go back through five years of e-mails, you can go back 10 years of e-mails,” McNicoll is quoted as saying. "The Clinton administration was doing this too — they were using e-mail accounts that were outside the presidential records system."

of course this was issued as a threat but i think it's a wonderful idea... if we're going to undertake the national cleansing we so desperately need, let's do it right and let the chips fall where they may...

Go, Henry...!!

(this post is as much to tweak section9's nose as it is to report on waxman's latest inquiry...)
The head of the House Committee on Oversight and Governance Reform warned today of a "systematic failure" in basic security procedures as well as the safeguarding of classified information in the White House of President George W. Bush.

"Multiple current and former White House security personnel have informed my staff that White House practices have been dangerously inadequate with respect to investigating security violations, taking corrective action following breaches, and physically securing classified information," Rep. Henry Waxman (D-CA) wrote to former White House Chief of Staff Andrew Card today.

Waxman sought Card's cooperation in his probe of a "systematic breakdown" in White House security procedures.

i'm glad this is being followed up... after knodell's revelations at the scooter libby trial, and the recent disclosure that rnc servers were routinely used by numerous white house staff for official government communications, any it director would (and should) be crapping little green apples... the fact that it involves the white house and therefore the country's most sensitive classified information, is deeply troubling...

Effective...? At WHAT...?

effective at turning the justice department into an operating arm of karl rove and the republican national committee...?
"As long as I think that I can be effective and the president believes that I should continue to be at the head of the Department of Justice, I'll continue serving," he told reporters.

[...]

Gonzales spoke just hours after Bush reaffirmed his confidence in his attorney general.

it's going down exactly as i predicted yesterday...
i fully expect gonzo to still be attorney general a week from today and, quite likely, a month from today... if george dumps him, it will not be until he can make it look like HIS decision rather than as a response to the hearings and political pressure, the same way he disposed of rummy...

there's only one thing that's going to break through the bushco stonewall, and that's a revelation of such staggering magnitude that it will bring the entire house of cards tumbling down... until then, bush isn't going to give one single inch, and will continue to wreak havoc on our country until 20 january 2009... the additional damage he can do between now and then boggles the mind...

In an interesting twist to events, the DNC is suing the DOJ

i am at a loss to explain why the democratic national committee is the one filing suit... are they claiming to be the aggrieved party or is it simply a suit filed as an expression of the common interest, much like c.r.e.w. would do...? can anyone enlighten me here...?
The Democratic National Committee sued the Justice Department on Thursday, demanding it turn over any e-mail traffic with the Republican Party on the U.S. attorneys controversy and criminal investigations.

[...]

Democrats suspect that White House officials used e-mail accounts provided by the Republican Party headquarters to avoid a permanent record of communications with the Justice Department involving political considerations in the appointment of prosecutors.

The Democratic Party's suit in federal court followed the Republicans' refusal for now to turn over e-mails to Congress. White House lawyers first will have an opportunity to review them to determine whether some should be kept secret.

Such a review is "commonplace," said a letter dated Wednesday and released by the Republican committee. Attorney Robert Kelner, representing the RNC, sent the letter to the chairman of the House Oversight and Government Reform Committee, Rep. Henry Waxman, a Democrat. Kelner gave no end date for the White House review.

another question is, does this help or hinder the work of the congressional investigation...?

Yes, obstruction of justice charges would be nice

how about an indictment for turning political discourse in the u.s. into a screaming hate fest...? how about satan returning to claim the marker on your soul...?
A major government watchdog organization has warned that White House officials, including Karl Rove, could face a number of obstruction of justice charges for the way they used outside e-mail accounts and failed to properly archive e-mails on White House servers.

"[Special Counsel Patrick] Fitzgerald could decide to reopen the case," said Melanie Sloan, Executive Director of Citizens for Responsibility and Ethics in Washington, referring to the probe over who leaked the identity of covert CIA agent Valerie Plame Wilson. "And if it turns out that e-mail was deleted from the RNC server as suggested by the Waxman letter, that could lead to new obstruction of justice charges."

such an odious human being is just crying out for appropriate consequences... oh, yes, the others too... ;)

Ok, here's what I don't get

if i stepped into a position like karl rove's, a deputy chief of staff to the president of the united states, i would be humbled by what i would consider to be a sacred obligation to serve my country in the most upstanding, ethical, squeakiest clean way possible, to serve as nothing less than a paragon of virtue that would bring honor to me, my boss, and my country... every single day, i would be cognizant that i was not there to serve anything other than the common good, and all that i did must meet that end... when i worked at united airlines, there was no question in my mind that we were there to provide a safe, reliable, efficient, economical, and fast way to move people and goods from one point to another...

yeah, i know there are lots of different kinds of people out there and it's evident that there aren't nearly enough who think like i do, but what, i would like to know, makes it such a difficult concept that it doesn't take root in the minds of our public servants...? it irritates the ever-loving shit outta me to have to read crap like this...

[I]n January 2006, special prosecutor Patrick Fitzgerald informed the Scooter Libby defense team that some of Rove’s emails from his White House account in 2003 were not saved as required by federal law.

[...]

The controversy surrounding Rove this week has involved his RNC email account. The RNC acknowledged that, while they instituted a new policy in 2004 to preserve emails, there appear to be no records from White House senior political adviser Karl Rove until 2005, leaving open “the possibility that Rove had personally deleted the missing e-mails.” According to the RNC, the Committee took action specifically and singularly against Rove in 2005 to keep him “from deleting his e-mails from the RNC server.”

one of the things foremost in my mind would be that everything i did would be part of the historical record, potentially available and open at any time to public scrutiny, something i would consider right and appropriate for someone serving as a steward of the public trust... i would be almost obsessive about making sure that records were properly kept, maintained, and accessible right from the moment i first set foot in my office... i guess that's just me...

Fred Fielding's "unified offer"

TPMmuckraker translates the latest from the white house on the requested documents...
You can read the letter White House counsel Fred Fielding sent last night to Congress about the U.S. attorneys investigation here.

But here's the shorter version of the "offer":
Dear Congress,

You'll get what we want you to get when we want you to get it, or you'll get nothing.

Best,
Fred Fielding

In the letter, Fielding says that the White House's offer of March 20th stands. It's a great offer, he says. And carping from Democrats and some Republicans like Sen. Arlen Specter (R-PA) about it fails "to credit fully the extraordinary nature of the disclosure we are prepared to provide."

The offer, remember, was 1) to turn over records of all relevant communications from a White House official to a party outside the White House (but no internal communications are to be turned over) and 2) Karl Rove and other White House officials would meet with Congress privately, but there would be no transcript and no oath. The offer also restricts the range of questioning.

But it gets better. Those RNC-issued email accounts belonging to White House staff are also to be covered under the deal. And Fielding says "it was and remains our intention to collect e-mails and documents from those [RNC-controlled] accounts."

In other words, whatever emails Congress gets, they'll have to get through the White House -- and they won't get anything unless they get it as part of Fielding's "unified offer," his “carefully and thoughtfully considered package of accommodations.”

dear fred,

please take your "unified offer" and carefully but firmly insert it into that special place where the sun does not shine...

respectfully,

profmarcus

Sweat, Gonzo, sweat

it's too bad he didn't work as hard doing his job the RIGHT way, protecting the u.s. constitution and fostering a justice system that works for the benefit of all americans...
After struggling for weeks to explain the extent of his involvement in the firings of eight U.S. attorneys, Gonzales and his aides are viewing the Senate testimony on April 12 and April 17 as seriously as if it were a confirmation proceeding for a Supreme Court or a Cabinet appointment, officials said.

Ed Gillespie, a former Republican National Committee chairman, and Timothy E. Flanigan, who worked for Gonzales at the White House, have met with the attorney general to plot strategy. The department has scheduled three days of rigorous mock testimony sessions next week and Gonzales has placed phone calls to more than a dozen GOP lawmakers seeking support, officials said.

i sincerely hope he's terrified...

Pulling in the RNC along with DOJ and the White House

this is good... this is very, very good...
Today, oversight committee chairman Henry Waxman (D-CA) issued a letter to the Republican National Committee requesting it turn over all email communications by White House officials relating to the presentation.
In communicating with GSA about the presentation, Mr. Jennings and his assistant used “gwb43.com” e-mail accounts maintained by the RNC rather than their official White House e-mail accounts. In their e-mails, they described the presentation as a “close hold” and said that “we’re not supposed to be emailing it around.”

To assist the Committee in its investigation of these issues, I request that you provide any electronic messages sent or received by Karl Rove, J. Scott Jennings, or any other White House officials using accounts maintained by the RNC that relate to (1) the January 26, 2007, PowerPoint presentation at GSA, (2) the presentation of any similar political briefings at other federal agencies or to other federal employees, or (3) the use of federal agencies or resources to help Republican candidates.

since kyle sampson 'splained it all for us, that politics and performance are the same thing, it's only fair that the republican party is now a target of the congressional investigation... i don't think the rnc will be able to use "executive privilege" to get out of this one...
