from time to time on this blog, i have railed against individuals i consider to be high profile examples of what is wrong in this country and the world... karl rove, carl icahn, donald rumsfeld, george bush, lloyd blankfein, bill kristol and a number of others spring to mind... yesterday's post by robert scheer in truthdig added yet another name to my black list - sanford weill...

How evil is this? At a time when two-thirds of U.S. homeowners are drowning in mortgage debt and the American dream has crashed for tens of millions more, Sanford Weill, the banker most responsible for the nation’s economic collapse, has been elected to the American Academy of Arts & Sciences.

So much for the academy’s proclaimed “230-plus year history of recognizing some of the world’s most accomplished scholars, scientists, writers, artists, and civic, corporate, and philanthropic leaders.” George Washington, Ralph Waldo Emerson and Albert Einstein must be rolling in their graves at the news that Weill, “philanthropist and retired Citigroup Chairman,” has joined their ranks.

Weill is the Wall Street hustler who led the successful lobbying to reverse the Glass-Steagall law, which long had been a barrier between investment and commercial banks. That 1999 reversal permitted the merger of Travelers and Citibank, thereby creating Citigroup as the largest of the “too big to fail” banks eventually bailed out by taxpayers. Weill was instrumental in getting then-President Bill Clinton to sign off on the Republican-sponsored legislation that upended the sensible restraints on finance capital that had worked splendidly since the Great Depression.

Reed, Citibank CEO when has had the honesty to acknowledge that the elimination of Glass-Steagall was a disaster: “I would compartmentalize the industry for the same reason you compartmentalize ships,” he told Bloomberg News. “If you have a leak, the leak doesn’t spread and sink the whole vessel. So generally speaking, you’d have consumer banking separate from trading bonds and equity.”

Ashcroft, Rumsfeld and Tenet urged the 9/11 Commission to limit its investigation

i'm so tired of all these little bits and pieces when at this point in time we can be reasonably sure we still don't know the whole story...

anyway, here's another little piece...

Senior Bush administration officials sternly cautioned the 9/11 Commission against probing too deeply into the terrorist attacks of September 11, 2001, according to a document recently obtained by the ACLU.

The notification came in a letter dated January 6, 2004, addressed by Attorney General John Ashcroft, Defense Secretary Donald H. Rumsfeld and CIA Director George J. Tenet [ACLU PDF document, page 26]. The ACLU described it as a fax sent by David Addington, then-counsel to former vice president Dick Cheney.

In the message, the officials denied the bipartisan commission's request to question terrorist detainees, informing its two senior-most members that doing so would "cross" a "line" and obstruct the administration's ability to protect the nation.

Note to DOJ Special Prosecutor John Durham: the "Decider" is the one ultimately accountable

On April 11, 2008, ABC News produced a video interview of Bush during which he was asked about meetings his top subordinates had held to approve specific instances of torture. Bush said: "And yes, I'm aware our national security team met on this issue. And I approved." The National Security Council's Principals Committee, which held the meetings, included Vice President Dick Cheney, National Security Adviser Condoleezza Rice, Defense Secretary Donald Rumsfeld, Secretary of State Colin Powell, CIA Director George Tenet, and Attorney General John Ashcroft. In the same interview, Bush defended the use of the drowning torture on prisoner Khalid Sheikh Mohammed, saying: "We had legal opinions that enabled us to do it. And no, I didn't have any problem at all trying to find out what Khalid Sheikh Mohammed knew."

On January 11, 2009, Fox News aired a video interview of Bush in which he admitted personally authorizing the torture of Khalid Sheikh Mohammed, saying: "One such person who gave us information was Khalid Sheikh Mohammed. … And I’m in the Oval Office and I am told that we have captured Khalid Sheikh Mohammed and the professionals believe he has information necessary to secure the country. So I ask what tools are available for us to find information from him and they gave me a list of tools, and I said are these tools deemed to be legal? And so we got legal opinions before any decision was made."

Does anyone else verify this? Well, how about John Yoo and Dick Cheney? On January 29, 2009, John Yoo, a former official in the Office of Legal Counsel who had drafted secret memos authorizing torture, published an article in the Wall Street Journal with the headline "Obama Made a Rash Decision on Gitmo," in which he wrote: "On the advice of his intelligence advisers, the president could have authorized coercive interrogation methods like those used by Israel and Great Britain in their antiterrorism campaigns. (He could even authorize waterboarding, which he did three times in the years after 9/11.)"

On May 10, 2009, former Vice President Cheney appeared on the CBS News television program "Face the Nation." Asked what Bush had known about torture methods, Cheney replied, "I certainly, yes, have every reason to believe he knew -- he knew a great deal about the program. He basically authorized it. I mean, this was a presidential-level decision. And the decision went to the president. He signed off on it."

OK, but did Bush put his approval down in writing anywhere? He certainly did. On Sept. 17, 2001, Bush produced an executive order authorizing the CIA to set up unacknowledged detention facilities around the world. For years after this date, prisoners in these facilities were not identified to the International Committee of the Red Cross or provided due process. On February 7, 2002, Bush produced a Memorandum for the Vice President, the Secretary of State, the Secretary of Defense, the Attorney General, Chief of Staff to the President, Director of Central Intelligence, Assistant to the President for National Security Affairs, and Chairman of the Joint Chiefs of Staff on the subject of "Humane Treatment of al Qaeda and Taliban Detainees." In this memorandum, Bush "determined" that "none of the provisions of Geneva apply to our conflict with al Qaeda in Afghanistan or elsewhere throughout the world," and "[C]ommon article 3 of Geneva does not apply to either al Qaeda or Taliban detainees," and "[T]he Taliban detainees are unlawful combatants and, therefore, do not qualify as prisoners of war under article 4 of Geneva," and "al Qaeda detainees also do not qualify as prisoners of war."

50 top U.S. war criminals

Compiled below, in hopes that it may be of some assistance to Eric Holder, John Conyers, Patrick Leahy, active citizens, foreign courts, the International Criminal Court, law firms preparing civil suits, and local or state prosecutors with decency and nerve is a list of 50 top living U.S. war criminals. These are men and women who helped to launch wars of aggression or who have been complicit in lesser war crimes. These are not the lowest-ranking employees or troops who managed to stray from official criminal policies. These are the makers of those policies.

The occupations of Iraq and Afghanistan have seen the United States target civilians, journalists, hospitals, and ambulances, use antipersonnel weapons including cluster bombs in densely settled urban areas, use white phosphorous as a weapon, use depleted uranium weapons, employ a new version of napalm found in Mark 77 firebombs, engage in collective punishment of Iraqi civilian populations -- including by blocking roads, cutting electricity and water, destroying fuel stations, planting bombs in farm fields, demolishing houses, and plowing down orchards -- detain people without charge or legal process without the rights of prisoners of war, imprison children, torture, and murder.

The list below does not include those responsible for war crimes prior to 2001. Nor does it include those currently in power who are making themselves complicit by failing to prosecute or cease commission of these crimes. The list could be greatly expanded. It could also be narrowed. I would argue, however, that it presents a more reasonable starting place than Holder's reported proposal to investigate only CIA employees who failed to comply with criminal torture policies, of whom there are no doubt more than 50.

Because each of the people on this list should be nonviolently protested everywhere they go (more on that below), I have organized them by location. Please post updates on where they are as comments at http://afterdowningstreet.org/warcriminals

CALIFORNIA

1. John Yoo: Professor of Law at Boalt Hall School of Law in Berkeley, California, with house at 1241 Grizzly Peak Blvd., Berkeley, (but a lawyer with the Pennsylvania bar from which he should be disbarred and would be if enough people demanded it) counseled the White House on how to get away with war crimes, wrote this memo promoting presidential power to launch aggressive war, and claimed the power to decree that the federal statutes against torture, assault, maiming, and stalking do not apply to the military in the conduct of the war, and to announce a new definition of torture limiting it to acts causing intense pain or suffering equivalent to pain associated with serious physical injury so severe that death, organ failure or permanent damage resulting in loss of significant body functions will likely result. Yoo claimed in 2005 that a president has the right to enhance an interrogation by crushing the testicles of someone's child. Yoo has been confronted in his classroom: video, and defended by the Washington Post, and again confronted in the classroom.

5. William J. "Jim" Haynes, II: was General Counsel to the Department of War ("Defense"). He is now Chief Corporate Counsel at the Chevron Corporate Office in San Ramon, California. He counseled the White House on how to get away with war crimes, including by drafting memos for Yoo. Works at Chevron Headquarters, 6001 Bollinger Canyon Road, San Ramon, CA 94583. It explained that under the 1996 War Crimes Act, U.S. officials might be prosecuted for violating the Geneva Conventions for actions in Afghanistan (and future parts of the "war on terror"), with penalties up to and including death. He suggested that Bush declare that the Taliban and Al Qaeda weren't covered by Geneva, to be on the safe side. Bush did so. Gonzo now has a job at Texas Tech, but not teaching law. 29. Paul Wolfowitz: lives in Chevey Chase, Maryland, and is a visiting scholar at the American Enterprise Institute in Washington, D.C., advocated illegal war of aggression, and pushed for wars of aggression for years as a participant in the Project for a New American Century.

30. Doug Feith: serves on the faculty of the Edmund A. Walsh School of Foreign Service at Georgetown University in Washington, D.C., as a Professor and Distinguished Practitioner in National Security Policy, manufactured, cherry picked, and distorted information, and pressured others to do the same, to help build a false case for an illegal war of aggression, and advocated early and openly for an illegal war of aggression against a "non-al qaeda target." Even while Addington, Gonzales and the lawyers were beginning to build the legal framework for torture, a couple of military psychologists were laying out the techniques the military would use. James Mitchell, a retired military psychologist, had been a leading expert in the military's SERE program. In December 2001, with his partner, Bruce Jessen, Mitchell reverse-engineered SERE techniques to be used to interrogate detainees. Then, in the spring of 2002, before OLC gave official legal approval to torture, Mitchell oversaw Abu Zubaydah's interrogation. An FBI agent on the scene describes Mitchell overseeing the use of "borderline torture." And after OLC approved waterboarding, Mitchell oversaw its use in ways that exceeded the guidelines in the OLC memo. Under Mitchell's guidance, interrogators used the waterboard with "far greater frequency than initially indicated" -- a total of 183 times in a month for Khalid Sheikh Mohammed and 83 times in a month for Abu Zubaydah.

Professor Cole reads my mind

and does an infinitely better job of articulating the matter than i would have done...

The US military has, understandably, condemned the coerced video of a US soldier taken hostage by Taliban in Afghanistan.

But I fear that the argument that the public humiliation of prisoners is against international law won't take the US very far after 8 years of Bush-Cheney.

After the evidence surfaced that the US military took all those humiliating pictures of prisoners at Abu Ghraib to blackmail them by threatening to make them public, the US assertion of support for this principle of the Geneva Conventions will be met with, well, let us say substantial skepticism.

In fact, as I was reminded by a former ambassador, the Bush-Cheney- Yoo-Armitage gutting of US conformance with the Geneva Conventions really makes it difficult for Washington credibly to complain about the treatment of any of our captured soldiers. The Taliban could hold the soldier hostage forever if they follow the principle put forward by Sen. Lindsey Graham. They could (God forbid) put him in stress positions naked and threaten to release the pictures to his family, and they would have done nothing that Rumsfeld's Pentagon had not done routinely and on a vast scale.

The US refusal to so much as investigate American officials implicated in torture and breaking international law also does not help us gain credibility on seeing to it that those who mistreat our troops are tried on those charges. We even have Dick Cheney defending waterboarding, for which Japanese generals were tried and executed after WW II. It is disgusting.

And huffing and puffing that the Taliban are not a government won't get us very far either. They control 10 percent of the country.

You obey the Geneva Convention and the rest of international law on the treatment of captives because it gives you the moral high ground with regard to the treatment of our troops. Not doing so endangers every single one of our men and women in uniform.

What is really scary is that the shadowy set of secret military and intelligence teams charged by Cheney to break international law continuing to do so despite President Obama's orders to cease torture. Obama had better get a handle on this issue, because it could well blow up in his face, in fact, Cheney may intend it to do so. I think there are still people in the US government who take their cues from the latter rather than the former.

the other day when i saw the news item about the u.s. protest, it crossed my mind to put up a post about it with essentially the same views expressed... then i thought, well, there's certainly nothing new about the u.s. having lost the moral high ground and neither is there anything new about bald-faced u.s. hypocrisy, so why bother...

while i totally agree that the u.s. protest was warranted, unless and until we, as a country, can face up to our own shortcomings (shortcomings...! HA...! how's THAT for a euphemism?), any such protest is only going to generate the kind of derision it so richly deserves...

i'm not wild about this decision, to say the least, but i might find it a little easier to swallow IF it was combined with an announcement that those responsible for authorizing the torture-based interrogation techniques were going to be held accountable... unfortunately, whatever hope i might have held for the restoration of accountability and the rule of law under obama is fast fading...

America's most senior general was "hoodwinked" by top Bush administration officials determined to push through aggressive interrogation techniques of terror suspects held at Guantánamo Bay, leading to the US military abandoning its age-old ban on the cruel and inhumane treatment of prisoners, the Guardian reveals today.

General Richard Myers, chairman of the US joint chiefs of staff from 2001 to 2005, wrongly believed that inmates at Guantánamo and other prisons were protected by the Geneva conventions and from abuse tantamount to torture.

The way he was duped by senior officials in Washington, who believed the Geneva conventions and other traditional safeguards were out of date, is disclosed in a devastating account of their role, extracts of which appear in today's Guardian.

In his new book, Torture Team, Philippe Sands QC, professor of law at University College London, reveals that:

· Senior Bush administration figures pushed through previously outlawed measures with the aid of inexperienced military officials at Guantánamo.

· Myers believes he was a victim of "intrigue" by top lawyers at the department of justice, the office of vice-president Dick Cheney, and at Donald Rumsfeld's defence department.

· The Guantánamo lawyers charged with devising interrogation techniques were inspired by the exploits of Jack Bauer in the American TV series 24.

· Myers wrongly believed interrogation techniques had been taken from the army's field manual.

The lawyers, all political appointees, who pushed through the interrogation techniques were Alberto Gonzales, David Addington and William Haynes. Also involved were Doug Feith, Rumsfeld's under-secretary for policy, and Jay Bybee and John Yoo, two assistant attorney generals.

here's a thought from juan cole who, rightly, bemoans our country's failure to hold these criminals to account...

Lawrence Wilkerson, Colin Powell's former chief of staff, is quoted as saying that the perpetrators of torture could well be arrested and tried in other countries as war criminals if they travel abroad. It is an index of the despotism to which the United States has fallen victim that we must hope for other, more civilized countries, to try our war criminals. Why can't public officials be prosecuted for violating the Bill of Rights' guarantee against cruel and unusual torture? Why can't an International Military Tribunal be set up as at Nuremberg?

Congress should repeal the provision of the Military Commissions Act that would give Yoo immunity from prosecution for torture committed from September 11, 2001 to December 30, 2005. John Yoo should be disbarred and he should not be retained as a professor of law at one of the country’s premier law schools. John Yoo should be dismissed from Boalt Hall [University of California, Berkeley, Law School] and tried as a war criminal.

now, let's apply the same standard to bush, cheney, rumsfeld, condi, colin, ashcroft, alberto, addington, and the rest of the war criminals...

Torture starts at the top (as if we didn't know)

more "news" we've known all along...
U.S. President George W. Bush's most senior advisers approved "enhanced interrogation techniques" of top al Qaeda suspects by the Central Intelligence Agency, ABC News reported on Wednesday, citing sources it did not name.

ABC reported that the so-called "principals" discussed interrogation details in dozens of top-secret talks and meetings in the White House.

Then national security adviser Condoleezza Rice chaired the meetings, which took place in the White House Situation Room and were typically attended by a select group of senior officials or their deputies, ABC said.

"Highly placed sources said a handful of top advisers signed off on how the CIA would interrogate top al Qaeda suspects -- whether they would be slapped, pushed, deprived of sleep or subjected to simulated drowning, called waterboarding," ABC reported.

In addition to Rice, the principals at the time included Vice President Cheney, Defense Secretary Donald Rumsfeld and Secretary of State Colin Powell, CIA Director George Tenet and Attorney General John Ashcroft, the report said.

anybody who believed for a single minute that those poor low-level schmucks that took the rap for abu ghraib were acting on their own initiative has been smoking some truly powerful shit...

morgan strong reviews the recent pbc frontline documentary on five years of the iraq war for robert parry's consortium news...
What the broadcast revealed was nothing new. Others have engaged the subject as thoroughly as did Frontline. What we did see in this broadcast, however, was a compilation of the deceit, pettiness, treachery, arrogance, ignorance and stunning callousness by those who took us into this vile war.

The key figures who promoted the war were Paul Wolfowitz, Richard Perle, Dick Cheney, Donald Rumsfeld and Lewis Libby. Those names were not new, but a new motive for the war was revealed: the recognition of Israel by a new democratic Iraq.

thank goodness we have these chronicles of treachery... they serve as a foundation for the truth of this illegal and immoral war...

Flying in the face of statements members of the Bush Administration have made denying the use, and advocacy, of torture in their war effort, evidence of brutal treatment of captives continues to accumulate.

PBS' Bill Moyers delves into Oscar-nominated documentary "Taxi to the Dark Side," highlighting an Afghan taxi driver who was detained and beaten to death by American forces.

"Go see it," says Moyers. "Not in a while has the truth hit so hard."

In 2002, Dilawar, 22, and his passengers were stopped at Bagram Air Base and held under suspicion of involvement in a rocket attack. Five days later, his death from blunt force trauma would be ruled a homicide, as written on the death certificate, in English, given to Dilawar's family with his body.

Captain Carolyn Wood, overseeing interrogation at Bagram, would be awarded a Bronze Star for "valor" and tapped to begin similar operations at the infamous Abu Ghraib prison.

Prisoners were assigned numbers, which were written on sheets of paper hung outside the airlocks in which they were kept, and directly on their bodies.

"Detainees were actually chained with their hands above their heads in these airlocks," says Moazzam Begg. "His number, 421, was something that I could see often, because his back was towards me."

"There were always officers coming and going through the facility," says Eric Lahammer. "We kind of joked about it as being the 'greatest show on earth'; everyone wanted to come and look at the 'terrorists.'"


there is only one thing that can be done to restore the dignity of our country... the bush administration must be removed from office prior to the expiration of its term, and the key members of that administration must be prosecuted for war crimes... there is nothing else we could possibly do to demonstrate that we are serious about reclaiming the bright light that used to shine from our shores...

because i think the information jim put up last night is so terribly important, i'm posting the entire center for public integrity report here... also, since the center's site server is maddeningly slow, this will be a little more convenient for those who want to read it all...


False Pretenses

Following 9/11, President Bush and seven top officials of his administration waged a carefully orchestrated campaign of misinformation about the threat posed by Saddam Hussein's Iraq.

President George W. Bush and seven of his administration's top officials, including Vice President Dick Cheney, National Security Adviser Condoleezza Rice, and Defense Secretary Donald Rumsfeld, made at least 935 false statements in the two years following September 11, 2001, about the national security threat posed by Saddam Hussein's Iraq. Nearly five years after the U.S. invasion of Iraq, an exhaustive examination of the record shows that the statements were part of an orchestrated campaign that effectively galvanized public opinion and, in the process, led the nation to war under decidedly false pretenses.

On at least 532 separate occasions (in speeches, briefings, interviews, testimony, and the like), Bush and these three key officials, along with Secretary of State Colin Powell, Deputy Defense Secretary Paul Wolfowitz, and White House press secretaries Ari Fleischer and Scott McClellan, stated unequivocally that Iraq had weapons of mass destruction (or was trying to produce or obtain them), links to Al Qaeda, or both. This concerted effort was the underpinning of the Bush administration's case for war.

It is now beyond dispute that Iraq did not possess any weapons of mass destruction or have meaningful ties to Al Qaeda. This was the conclusion of numerous bipartisan government investigations, including those by the Senate Select Committee on Intelligence (2004 and 2006), the 9/11 Commission, and the multinational Iraq Survey Group, whose "Duelfer Report" established that Saddam Hussein had terminated Iraq's nuclear program in 1991 and made little effort to restart it.

In short, the Bush administration led the nation to war on the basis of erroneous information that it methodically propagated and that culminated in military action against Iraq on March 19, 2003. Not surprisingly, the officials with the most opportunities to make speeches, grant media interviews, and otherwise frame the public debate also made the most false statements, according to this first-ever analysis of the entire body of prewar rhetoric.

President Bush, for example, made 232 false statements about weapons of mass destruction in Iraq and another 28 false statements about Iraq's links to Al Qaeda. Secretary of State Powell had the second-highest total in the two-year period, with 244 false statements about weapons of mass destruction in Iraq and 10 about Iraq's links to Al Qaeda. Rumsfeld and Fleischer each made 109 false statements, followed by Wolfowitz (with 85), Rice (with 56), Cheney (with 48), and McClellan (with 14).

The massive database at the heart of this project juxtaposes what President Bush and these seven top officials were saying for public consumption against what was known, or should have been known, on a day-to-day basis. This fully searchable database includes the public statements, drawn from both primary sources (such as official transcripts) and secondary sources (chiefly major news organizations) over the two years beginning on September 11, 2001. It also interlaces relevant information from more than 25 government reports, books, articles, speeches, and interviews.

Consider, for example, these false public statements made in the run-up to war:

  • On August 26, 2002, in an address to the national convention of the Veteran of Foreign Wars, Cheney flatly declared: "Simply stated, there is no doubt that Saddam Hussein now has weapons of mass destruction. There is no doubt he is amassing them to use against our friends, against our allies, and against us." In fact, former CIA Director George Tenet later recalled, Cheney's assertions went well beyond his agency's assessments at the time. Another CIA official, referring to the same speech, told journalist Ron Suskind, "Our reaction was, 'Where is he getting this stuff from?' "
  • In the closing days of September 2002, with a congressional vote fast approaching on authorizing the use of military force in Iraq, Bush told the nation in his weekly radio address: "The Iraqi regime possesses biological and chemical weapons, is rebuilding the facilities to make more and, according to the British government, could launch a biological or chemical attack in as little as 45 minutes after the order is given. . . . This regime is seeking a nuclear bomb, and with fissile material could build one within a year." A few days later, similar findings were also included in a much-hurried National Intelligence Estimate on Iraq's weapons of mass destruction — an analysis that hadn't been done in years, as the intelligence community had deemed it unnecessary and the White House hadn't requested it.
  • In July 2002, Rumsfeld had a one-word answer for reporters who asked whether Iraq had relationships with Al Qaeda terrorists: "Sure." In fact, an assessment issued that same month by the Defense Intelligence Agency (and confirmed weeks later by CIA Director Tenet) found an absence of "compelling evidence demonstrating direct cooperation between the government of Iraq and Al Qaeda." What's more, an earlier DIA assessment said that "the nature of the regime's relationship with Al Qaeda is unclear."
  • On May 29, 2003, in an interview with Polish TV, President Bush declared: "We found the weapons of mass destruction. We found biological laboratories." But as journalist Bob Woodward reported in State of Denial, days earlier a team of civilian experts dispatched to examine the two mobile labs found in Iraq had concluded in a field report that the labs were not for biological weapons. The team's final report, completed the following month, concluded that the labs had probably been used to manufacture hydrogen for weather balloons.
  • On January 28, 2003, in his annual State of the Union address, Bush asserted: "The British government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa. Our intelligence sources tell us that he has attempted to purchase high-strength aluminum tubes suitable for nuclear weapons production." Two weeks earlier, an analyst with the State Department's Bureau of Intelligence and Research sent an email to colleagues in the intelligence community laying out why he believed the uranium-purchase agreement "probably is a hoax."
  • On February 5, 2003, in an address to the United Nations Security Council, Powell said: "What we're giving you are facts and conclusions based on solid intelligence. I will cite some examples, and these are from human sources." As it turned out, however, two of the main human sources to which Powell referred had provided false information. One was an Iraqi con artist, code-named "Curveball," whom American intelligence officials were dubious about and in fact had never even spoken to. The other was an Al Qaeda detainee, Ibn al-Sheikh al-Libi, who had reportedly been sent to Eqypt by the CIA and tortured and who later recanted the information he had provided. Libi told the CIA in January 2004 that he had "decided he would fabricate any information interrogators wanted in order to gain better treatment and avoid being handed over to [a foreign government]."

The false statements dramatically increased in August 2002, with congressional consideration of a war resolution, then escalated through the mid-term elections and spiked even higher from January 2003 to the eve of the invasion.

like jim said, this is far from new information for most of us, but it's a big step forward to have the lies both carefully sourced and chronicled, and an even bigger step that some in the usually-comatose u.s. news media are paying attention, unlike the embarrassing silence over sibel edmonds... even as recently as 20 years ago, documented evidence like this would produce a massive public outcry for the wholesale resignation of the bush administration... how have we managed to become so anesthetized in so short a time...?

CASMII's fact sheet about the Iran-US Standoff




we occasionally see bits and pieces of these scattered about our own media, usually in the blogosphere, but rarely in traditional media outlets...

1. There is no evidence of a nuclear weapons programme in Iran . The US and its allies pressure Iran to prove that it is not hiding a nuclear weapons programme. This demand is logically impossible to satisfy and serves to make diplomacy fail in order to force regime change.
2. Iran 's need for nuclear power generation is real. Even when Iran 's population was one-third of what it is today, Dick Cheney, Donald Rumsfeld and Paul Wolfowitz, negotiating on behalf of President Gerald Ford, persuaded the former Shah that Iran needed over twenty nuclear reactors.
3. The "crisis" over Iran 's nuclear programme lacks the urgency claimed by Washington . Weapons grade uranium must be enriched at least to 85%. A 2005 CIA report determined that it could take Iran 10 years to achieve this level of enrichment. Many independent nuclear experts have stated that Iran would face formidable technical obstacles if it tried to enrich uranium beyond the 3.5% purity required for electricity generation.
4. Iran has met its obligations under the Nuclear non-Proliferation Treaty (NPT). Iran voluntarily accepted and enforced safeguards stricter than IAEA's Additional Protocol until February 2006, when Iran 's nuclear file was reported, under the pressure from the US , to the Security Council. (The US , by contrast, has neither signed nor implemented the Additional Protocol, and Israel has refused to sign the NPT.)
5. Iran has given unprecedented concessions on its nuclear programme.
6. Enrichment of uranium for a civilian nuclear programme is Iran 's inalienable right. Every member of the NPT has the right to enrich uranium for a civilian nuclear programme and is entitled to full technical assistance.
7. The Western alliance has not tried true diplomacy and relies instead on threats.
8. The UN resolutions against Iran , in contrast to the treatment of the US allies, South Korea , India , Pakistan , and Israel , smack of double standards. For example, in the year 2000, South Korea enriched 200 milligrams of uranium to near-weapons grade (up to 77%), but was not referred to the UN Security Council.
9. Iran has not threatened Israel or attacked another country. The track records of the US , Israel , the UK and France are very different. These so called “democracies” have a bloody history of invading other countries. Iran 's supreme leader, Ayatollah Khamenei, has declared repeatedly that Iran will not attack or threaten any country. He has also issued a fatwa against the production, stockpiling and use of nuclear weapons and banned nuclear weapons as sacrilegious.
10. The US “democratization” programme for Iran is a hoax. Although violations of human rights and democratic freedoms do occur too often in Iran , the country has the most pluralistic system in a region dominated by undemocratic client states of the US . It is sheer hypocrisy for the US, which turns a blind eye to the gross human rights abuses by its allies, such as Azerbaijan, Turkmenistan, Pakistan, Saudi Arabia, Israel, Libya, and Egypt, to misrepresent its agenda in Iran as a “democratization” programme.
11. There are no legal bases for Iran 's referral to the UN Security Council. Since there is no evidence that Iran is even contemplating to weaponize its nuclear programme, no grounds exist for this sidelining of the IAEA.
12. Dr ElBaradei, the head of the IAEA, has said that more sanctions are counterproductive. Economic sanctions on Iran will harm the people of Iran , as they were devastating to Iraqis, resulting in the death of at least 500,000 children. Sanctions would not however bring the Islamic Republic to its knees. Instead, any kind of sanctions, including the so-called "targeted" or "smart" sanctions, are viewed by the Iranian people as the West's punishment for Iran 's scientific progress (uranium enrichment for reactor fuel).
13. Sanctions are not better than war; they can be exploited as a diplomatic veneer and a provocative prelude to military attack, as they were in Iraq .
14. A US attack on Iran is imminent. The end of George Bush's presidency in 2009 could be a serious set back for the NeoCons' hegemonic dreams to control the energy resources in the region. He is unlikely to leave office bearing the legacy of failures in Afghanistan and Iraq and particularly leaving Iran a stronger player in the region.
15. Foreign state interference in Iran violates the UN charter. According to Seymour Hersch, the US is running covert operations in Iran to foment unrest and ethnic conflict for the purpose of regime change.
16. Reports of nuclear attack scenarios against Iran can serve to raise the public's tolerance for an act of aggression with conventional military means. People of conscience and sanity must not only condemn even contemplation of a nuclear attack, but also denounce any conventional attack.
17. Bombing cannot end Iran 's nuclear programme. Since Iran already has the expertise to enrich uranium up to the 3.5% grade for a fuel cycle, no degree of bombing will halt Iran 's civilian nuclear programme.
18. An attack on Iran will unite Iranians against the US and its allies. A great majority of the public in Iran support the country's right to enrich uranium for civilian purposes.
19. A nuclear attack on Iran would fuel a new nuclear arms race and ruin the NPT. Any military intervention against Iran will lead to a regional catastrophe and expanded terrorism.
20. The cause of democracy in Iran will suffer gravely if the country is attacked. President Bush's "axis of evil" rhetoric severely undermined the reformist movement in Iran at a time when the country's president promoted Dialogue Among Civilizations.

not that it should come as any great news to anybody that the abuse and torture of prisoners was authorized from the very top and has been integral to united states policy from the beginning...
The American Civil Liberties Union and Columbia University Press today announce the publication of Administration of Torture: A Documentary Record from Washington to Abu Ghraib and Beyond. Written by ACLU attorneys Jameel Jaffer and Amrit Singh, the book presents a detailed account of the treatment of prisoners held in U.S. detention centers in Afghanistan , Iraq , and Guantánamo Bay. Based on thousands of government documents obtained through the Freedom of Information Act, the book supplies substantial evidence that the torture and abuse of prisoners was systemic and resulted from decisions made by senior U.S. officials, both military and civilian.

Administration of Torture exposes the stark contradictions between the Bush administration's public disavowals of torture and the facts established by the administration's own documents. Jaffer and Singh write, "The fact that the Abu Ghraib photographs depicted abuse at a single prison allowed senior administration officials to claim, as they did repeatedly, that the abuse was confined to that facility. This claim was completely false, and senior officials almost certainly knew it to be so." They note that government documents show that prisoners were beaten, kicked, and abused at other detention facilities in Afghanistan and Iraq; that autopsy reports record numerous deaths in U.S. custody as homicides caused by strangulation, suffocation, or blunt-force injuries; and that documents from Guantánamo describe prisoners shackled in excruciating "stress positions," held in freezing-cold cells, forcibly stripped, hooded, terrorized with military dogs, and deprived of human contact for months. The authors also show – using the government's own documents – that officials were aware of the scope of the abuse problem well before the Abu Ghraib photographs were broadcast to the public.

Administration of Torture also contends that the abuse of prisoners took place because of policy, not in spite of it. Jaffer and Singh write, "the maltreatment of prisoners resulted in large part from decisions made by senior officials, both military and civilian. These decisions …were reaffirmed repeatedly, even in the fact of complaints from law enforcement and military personnel that the policies were illegal and ineffective, and even after countless prisoners …were abused, tortured, or killed in custody." They continue, "The documents show that senior officials endorsed the abuse of prisoners as a matter of policy – sometimes by tolerating it, sometimes by encouraging it, and sometimes by expressly authorizing it."

ok, now, let's be really damn clear on exactly what has been done in our names...
  • that Gen. Michael Dunlavey, who asked the Pentagon to approve more aggressive interrogation methods for use at Guantánamo, claims to have received "marching orders" from President Bush;
  • that according to an Army investigator, Defense Secretary Donald Rumsfeld was "personally involved" in overseeing the interrogation of Mohammed al Qahtani, a Guantánamo prisoner who was stripped naked, paraded in front of female interrogators, made to wear women's underwear on his head, led around on a leash, and forced to perform dog tricks. According to the investigator, while Rumsfeld did not himself authorize those specific methods, he failed to place a "throttle" over abusive "applications" of the "broad techniques" that he did authorize;
  • that interrogators who used abusive "SERE" (Survival, Evasion, Resistance, Escape) methods at Guantánamo did so because the Pentagon had endorsed those methods and required interrogators to be trained in the use of those methods;
  • that FBI personnel who complained of abuse at Guantánamo were complaining of abuse that had been authorized by the Defense Department chain of command;
  • that some of the Abu Ghraib photos showed prisoners being subjected to the very same interrogation methods that Rumsfeld had endorsed for use at Guantánamo;
  • that the plan of Maj. Gen. Geoffrey Miller to "Gitmoize" Abu Ghraib was endorsed by senior Defense Department officials;
  • that though the President and other senior officials insisted that abuse was limited to Abu Ghraib, a Defense Department "Information Paper" shows that, three weeks before the Abu Ghraib photos were leaked to the press, the Army was aware of at least 62 allegations of prisoner abuse in Afghanistan and Iraq, most of which did not relate to Abu Ghraib;
  • that the Defense Department held prisoners as young as 12 years old;
  • that the Defense Department approved holding prisoners in cells as small as 3.1 x 4.0 x 1.5 feet, and that special forces held prisoners in cells only slightly larger than that.

The NYT jumps on the context-free journalism bandwagon, this time on torture

(see update below...)

i absolutely hate it when stuff comes out and the media makes it sound like it's SUCH a surprise... context-free journalism should be illegal...

When the Justice Department publicly declared torture “abhorrent” in a legal opinion in December 2004, the Bush administration appeared to have abandoned its assertion of nearly unlimited presidential authority to order brutal interrogations.

But soon after Alberto R. Gonzales’s arrival as attorney general in February 2005, the Justice Department issued another opinion, this one in secret. It was a very different document, according to officials briefed on it, an expansive endorsement of the harshest interrogation techniques ever used by the Central Intelligence Agency.

The new opinion, the officials said, for the first time provided explicit authorization to barrage terror suspects with a combination of painful physical and psychological tactics, including head-slapping, simulated drowning and frigid temperatures.

so, the nyt says that "explicit authorization" was obtained "for the first time", eh...? what a load of bollocks... donald rumsfeld authored a memorandum on 27 november 2002 "explicitly authorizing" the use of torture techniques, a memo that led directly to general ricardo sanchez "explicitly authorizing" torture techniques to be used in iraq, specifically abu ghraib, contained in a memo written on 14 september 2003... folks, i've tracked this like a bloodhound for over two and one half years and posted about it repeatedly... (go look the posts up for yourselves, i don't have the patience to dig out the links...)

The use of techniques A-CC are subject to the general safeguards as provided below as well as specific implementation guidelines to be provided by the 205th MI BDE Commander. Specific implementation guidance with respect to techniques A-CC is provided in U.S. Army Field Manual 34-52. Further implementation guidance will be developed by the 205th MI BDE Commander.

Of the techniques set forth below, the policy aspects of certain techniques should be considered to the extent they reflect the views of other Coalition contributing nations. The description of the technique is annotated to include some policy issues that should be considered before application of the technique.

A. Direct: Asking straightforward questions.
*B. Incentive/Removal of Incentive: Providing a reward or removing a privilege above and beyond those that are required by the Geneva Convention from detainees. [Caution: Other nations that believe detainees are entitled to EPW protections may consider that provision and retention of religious items (e.g. the Koran) are protected under international law (see Geneva III, Article 34).]
C. Emotional Love: Playing on the love a detainee has for an individual or group.
D. Emotional Hate: Playing on the hatred a detainee has for an individual or group.
E. Fear Up Harsh: Significantly increasing the fear level in a detainee.
F. Fear Up Mild: Moderately increasing the fear level in a detainee.
G. Reduced Fear: Reducing the fear level in a detainee.
H. Pride and Ego Up: Boosting the ego of a detainee.
*I. Pride and Ego Down: Attacking or insulting the ego of a detainee not beyond the limits that would apply to an EPW. [Caution: Article 17 of Geneva III provides "Prisoners of war who refuse to answer may not be threatened, insulted, or exposed to any unpleasant or disadvantageous treatment of any kind." Other nations that believe detainees are entitled to EPW protections may consider this technique inconsistent with the provisions of Geneva.]
J. Futility: Invoking the feeling of futility of a detainee.
K. We Know All: Convincing the detainee that the interrogator already knows the answers to questions he asks the detainee.
L. Establish Your Identity: Convincing the detainee that the interrogator has mistaken the detainee for someone else.
M. Repetition: Continuously repeating the same question to the detainee within interrogaton periods of normal duration.
N. File and Dossier: Convincing detainee that the interrogator has a damning and inaccurate file which must be fixed.
*O. Mutt and Jeff: A team consisting of a friendly and harsh interrogator. The harsh interrogator might employ the Pride and Ego Down technique. [Caution: Other nations that believe that EPW protections apply to detainees may view this technique as inconsistent with Geneva III, Article 13 which provides that EPW's must be protected against acts of intimidation. Consideration should be given to these views prior to application of the technique.]
P. Rapid Fire: Questioning in rapid succession without allowing detainees to answer.
Q. Silence: Staring at the detainee to encourage discomfort.
R. Change of Scenery Up: Removing the detainee from the standard interrogaton setting (generally to a location more pleasant but no worse).
S. Change of Scenery Down: Removing the detainee from the standard interrogation setting and placing him in a setting that may be less comfortable; would not constitute a substantial change in environmental quality.
T. Dietary Manipulation: Changing the diet of a detainee; no intended deprivation of food or water; no adverse medical or cultural effect and without intent to deprive subject of food or water, e.g., hot rations to MREs.
*U. Environmental Manipulation: Allowing the environment to create moderate discomfort (e.g. adjusting temperatures or introducing an unpleasant smell). Conditions may not be such that they injure the detainee. Detainee is accompanied by interrogator at all times. [Caution: Based on court cases in other countries, some nations may view application of this technique in certain circumstances to be inhumane. Consideration of these views should be given prior to use of this technique.]
V. Sleep Adjustment: Adjustment of the sleeping times of the detainee (e.g. reversing sleep cycles from night to day). This technique is NOT sleep deprivation.
W. False Flag: Convincing the detainee that individuals from a country other than the United States are interrogating him.
*X. Isolation: Isolating the detainee from other detainees while still complying with basic standards of treatment. [Caution: the use of isolation as an interrogation technique requires detailed implementation instructions including specific guidelines regarding the length of isolation, medical and psychological review, and approval for extensions of the length of isolation by the 205th MI BDE Commander. Use of this technique for more than 30 days, whether continuous or not, must be briefed to 205th MI BDE Commander prior to implementation.]
Y. Presence of Military Working Dog: Exploits Arab fear of dogs while maintaining security during interrogations. Dogs will be muzzled and under control of MWD handler at all times to prevent contact with detainee.
Z. Sleep Management: Detainee provided minimum 4 hours of sleep per 24 hour period not to exceed 72 continuous hours.
AA. Yelling, Loud Music, and Light Control: Used to create fear, disorient detainee and prolong capture shock. Volume controlled to prevent injury.
BB. Deception: Use of falsified representations including documents and reports.
*CC. Stress Positions: Use of physical postures (sitting, standing, kneeling, prone, etc.) for no more than 1 hour per use. Use of technique(s) will not exceed 4 hours and adequate rest between use of each position will be provided.

[Note: Red asterisks - * - indicate techniques which, as noted, may either be excessive or violate the geneva conventions.

it's worth noting YET AGAIN that general sanchez perjured himself before the senate armed services committee in testimony he provided on 19 may 2004...

LIEUTENANT GENERAL RICARDO SANCHEZ, COMMANDER, MULTINATIONAL FORCE-IRAQ : Sir, that may be correct that it's in a news article, but I never approved any of those measures to be used within CJTF-7 at any time in the last year.

torture has been used since the get-go, and has been "explicitly authorized" at the highest levels of our government... nothing has changed... it has never stopped and, you can bet, is still going on today...

[UPDATE]
The Bush administration on Thursday denied reports that a secret Justice Department opinion in 2005 cleared the way for the return of painful interrogation tactics or superseded U.S. anti-torture law.

"This country does not torture," White House press secretary Dana Perino told reporters. "It is a policy of the United States that we do not torture and we do not."

what the hell do you expect them to say...? "well, doggone it, you finally caught us... yep, we torture, and, by golly, we LIKE it..." when can we toss this bunch out on the street...? i'm free this afternoon...
